Convict Tomas Doniña has admitted stabbing high-profile inmate Jaybee Sebastian to prevent him from testifying against Senator Leila de Lima over the proliferation of illegal drugs in the New Bilibid Prison (NBP).
This was disclosed by Police Superintendent Francisco Ebreo of the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG) who led the fact-finding probe into the supposed riot inside the national penitentiary on September 28, 2016 that resulted in the death of drug lord Tony Co.
According to the October 8 affidavit of Doniña, he said a former colleague from the Philippine Navy reportedly asked him to “silence and kill” Sebastian to prevent him from testifying against De Lima who purportedly received P10 million from Sebastian.
“Noong September 28, 7:45 ng umaga ay tinangka niyang patayin itong si Jaybee Sebastian sa kadahilanang may kumausap sa kanya na isang dati niyang kasamahan sa Philippine Navy na dapat ay gawan niya ng paraan para mapatahimik at mapatay si Jaybee Sebastian para hindi siya makapagsalita laban kay Ma’am De Lima ukol sa paglaganap ng droga sa New Bilibid Prison,” Ebreo said, reading Doniña’s affidavit.
Ebreo also clarified that based on their investigation, what happened on September was not a riot, but two separate, simultaneous stabbing attacks inside the makeshift room of Co and at the mess hall area, that left Co dead and Sebastian, Vicente Sy, Peter Co, and Clarence Dongail wounded.
“No riot or tumultuous affray occurred,” he told the panel.
“The incidents were triggered by separate causes and there was no showing that they acted together in a disruptive and tumultuous manner in carrying out a common purpose,” he said.
Ebreo also noted that based on evidence and results of the drug test on the inmates, including Co and records on seized illegal drugs and paraphernalia from the national penitentiary, illegal drugs “still exist” inside Building 14.
He said inmates Dongail, Edgar Sinco and Doniña may be held liable for the incident: Dongail for Co’s death and for the injuries of Peter Co and Vicente Sy; Sinco for the injuries sustained by Peter Co and Doniña for the injuries sustained by Sebastian.
Ebreo said no criminal case has been filed since the PNP-CIDG believes that it should be the NBP Investigation Section that will file the case.
“Since the place is under the jurisdiction of the NBP, their investigation section has the mandate to do the filing of cases. We recommended that they file the cases,” he said.
