Convicted carnapper and self-confessed drug trader Jaybee Sebastian filed a criminal complaint against Senator Leila de Lima and two other former prison officials for having endangered his life and forcing him to fund her senatorial campaign.
Sebastian’s wife Roxanne filed the 23-page complaint on his behalf before the Department of Justice, accompanied by their lawyer Eduardo Arriba.
Charged aside from de Lima were former Bureau of Corrections (BuCor) director Ricardo Reineir Cruz and former New Bilibid Prison (NBP) superintendent Richard Schwarzcopf Jr.
Sebastian accused the three of violating Section 3(e) of Republic Act (RA) 3019 or the Anti-Graft and Corrupt Practices Act, Section 5(a) of RA 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees and RA 9745 or the Anti-Torture Act of 2009.
De Lima was also charged for violating Section 3(k) of RA 3019; Presidential Decree (PD) No. 46 or the Act Punishing the Receiving and Giving of Gifts of Public Officials and Employees; and indirect bribery under Article 211 of the Revised Penal Code.
Arriba denied the Sebastians were pressured or offered incentives in filing the complaints.
The Sebastians’ legal counsel also bared plans to file another complaint against de Lima next week, this time before the Senate Committee on Ethics and Priveleges for her disclosure that Sebastian was a government asset, which he claimed endangered his client’s life.
Sebastian is held at Building 14 of the NBP but Arriba assured he would seek his transfer to a safer facility.
